ATTENTION MT. JACKSON GROUP MEMBERS:

 

Please be advised that our office has been very busy for the past four months, as we have been working tirelessly with the gas companies and the group’s marketing firm to close the group deals signed by Mt. Jackson Group landowners.  We have also been busy handling a variety of different issues that have arisen with group members concerning bonus payments and title issues.  In an effort to reconnect with our group members in person, we are scheduling some upcoming meetings in December and January.  PLEASE CAREFULLY READ THE MEETING DESCRIPTIONS BELOW SO THAT YOU CAN ASSESS WHICH MEETING WILL BE THE RIGHT MEETING FOR YOU TO ATTEND. All meetings are Morascyzk & Polochak sponsored meetings.

 

A)    For group members who have signed a lease with Chesapeake and Hilcorp, and who have either been paid their lease bonus or are awaiting payment of their lease bonus, please attend one of the following meetings:

 

Monday, December 5, 2011 at 6:00 p.m. at the Western Beaver High School Auditorium in Industry, PA      

                                                                 or  

 

Wednesday, December 7, 2011 at 6:00 p.m. at the Bessemer Croatian Club in Bessemer, PA

 

B)    For group members who have been informed by Chesapeake that they will not be paid a bonus because of a “title defect,” or due to a prior unexpired oil and gas lease with another company, including O&G Investment Holdings:

 

We will be scheduling a meeting for you in the Industry/Midland area in mid-January. At that time we will give you direction on your options, which are title curative work, top-leases, litigation, or formation of a new group. We will contact you with a letter and/or an e-mail at that time.  Please continue to check our website for updates on that meeting time. 

 

C)    For group members in Beaver County/Lawrence County/Mercer County/ Butler County that were part of the Mt. Jackson Group, but did not sign a lease with either Chesapeake or Hilcorp through the group leasing process:

 

We are committed to continue to work for any folks who do want us to work for them, and we are assisting those folks with pursuing options to lease at this time, as an individual or as a member of a smaller group.  We are going to schedule a meeting for mid-January in order to discuss what we can possibly do for these folks.  We will contact you with a letter and an e-mail at that time.  Please continue to check our website for updates on that meeting time.

This special page has been established for our Group landowners in western Beaver County, Pennsylvania. After several months of negotiations, the western Beaver County landowners in the Mt. Jackson Group have a pending offer on the table from Chesapeake Energy (click here for their website). This offer encompasses approximately 15,000 of the group's 44,000 acres.

Folks in the Group with property located in the following municipalities are subject to the offer, AND SHOULD ATTEND ONE OF THE UPCOMING LATE JULY MEETINGS:

Big Beaver Borough, Hookstown Borough, Brighton Township, Industry Borough, Chippewa Township, Midland Borough, Darlington Borough, New Galilee Borough*, Darlington Township, Ohioville Borough, Enon Valley Borough*, Potter Township, Georgetown Borough, Shippingport Borough, Glasgow Borough, South Beaver Township, Greene Township, Vanport Township

(* municipalities are "partial municipalities", meaning that only some acreage in these municipalites are included in the offer. Call Co-eXprise at 724 933-1180 if you are in these municipalities in order to verify inclusion in the offer)

At the meetings, the lease offer will be discussed and explained to group members by Co-eXprise, Inc., the Group's marketing firm, and attorneys from Morascyzk & Polochak, the attorneys for the Group. Morascyzk & Polochak will explain the legal terms IN GENERAL to the Group Members, and will also field questions from the Group Members. We also encourage all Group Members to feel free to SPEAK WITH THIER OWN ATTORNEY as well if they have individual, specific concerns with the lease as it pertains to their specific piece of property, and/or to get a second legal opinion on the lease.

After the meetings, Group Members will have until 5:00 p.m. on Thursday, August 4, 2011 to INDIVIDUALLY DECIDE WHETHER OR NOT TO ACCEPT THE OFFER. Group Members will show their acceptance by filling out the "ACCEPTANCE AGREEMENT" form posted below, and submitting it to Co-eXprise. Any Group Member or all Group Members may refuse to agree to lease with Chesapeake. Group members are encouraged to discuss the offer with their neighbors prior to signing the "ACCEPTANCE AGREEMENT". M&P's advice is that the offer should only be accepted if there is a firm consensus of Group Members that the offer is acceptable.

For those that accept the lease, Chesapeake will hold a mass signing event on August 5, 2011 at a time and location that will be announced in the very near future.

If you are in the Group and are not in one of the municipalities listed above, do not worry! Our office and Co-eXprise are working on separate deals with multiple buyers on the remainder of the Group acreage and hope to get those deals finalized soon, so that every group acre ends up leased.
